2. PRICES

Prices are displayed in the currency indicated on the website, including EUR or USD where applicable.

Unless otherwise stated, the price displayed for a product does not necessarily include shipping costs, customs duties, import taxes or other charges that may apply depending on the destination country.

Any applicable shipping costs will be displayed before the customer confirms their order.

For deliveries to countries where customs duties, import taxes or other charges apply, these charges may be payable by the customer in accordance with Section 8 of these Terms.

ARTENIS SARLU reserves the right to modify prices at any time.

The price applicable to an order is the price displayed on the website at the time the order is placed.

3. PRODUCT AVAILABILITY

Products are offered subject to availability.

Atlas & Geiger may offer products that are:

  • available for immediate shipment;

  • produced in limited quantities; or

  • made to order.

Where a product is made to order or subject to a specific production period, the estimated production time will be indicated on the relevant product page before the customer places the order.

If a product becomes unavailable after an order has been placed and ARTENIS SARLU is unable to fulfil the order, the customer will be informed and any payment already made for the unavailable product will be refunded.

4. ORDERS

The customer may place an order by following the ordering process available on the website.

Before completing the order, the customer will be given the opportunity to review the products selected, quantities, delivery information, applicable shipping costs and total price.

An order becomes binding once:

  1. the customer has confirmed the order;

  2. payment has been successfully authorised; and

  3. the customer has received an order confirmation from Atlas & Geiger.

The order confirmation will be sent electronically to the email address provided by the customer.

ARTENIS SARLU reserves the right to refuse or cancel an order where there are reasonable grounds to believe that:

  • the order is fraudulent;

  • payment has not been successfully authorised;

  • the customer has provided materially incorrect information;

  • the order is placed in violation of these Terms; or

  • there is a previous unresolved dispute involving the customer.

If payment has already been received for an order subsequently cancelled by ARTENIS SARLU, the amount paid will be refunded using the applicable payment method.

5. PAYMENT

Payment is due in full at the time the order is placed.

Payments are processed through the payment methods and payment service providers made available on the website.

ARTENIS SARLU does not have access to or store the customer's complete payment card details where payment is processed by an external payment service provider.

An order will only enter preparation or production once payment has been successfully confirmed.

6. PRODUCTION AND MADE-TO-ORDER PRODUCTS

Certain Atlas & Geiger creations may be produced in limited quantities or made to order.

Where applicable, the estimated production period will be displayed on the relevant product page.

Production times are estimates and may vary due to the artisanal nature of the manufacturing process, availability of materials or circumstances outside the reasonable control of ARTENIS SARLU.

If a significant delay is expected, the customer will be informed as soon as reasonably possible.

For personalised, customised or made-to-measure products, the customer may not have a right of withdrawal where an applicable law provides an exception for goods made to the customer's specifications or clearly personalised.

7. SHIPPING AND DELIVERY

Orders are shipped to the delivery address provided by the customer during checkout.

The estimated delivery time displayed on the website is an estimate and may vary depending on:

  • the destination;

  • the availability and production time of the product;

  • the carrier;

  • customs clearance;

  • public holidays; and

  • other circumstances outside the reasonable control of ARTENIS SARLU.

Where a specific delivery period has been agreed with the customer, that period will apply.

For consumers to whom EU consumer law applies, where no other delivery period has been agreed, the applicable statutory delivery rules will apply.

Where ARTENIS SARLU arranges the carrier, the risk of loss or damage to the goods remains with ARTENIS SARLU until the customer or a person designated by the customer takes physical possession of the goods, to the extent required by applicable law.

Customers are encouraged to inspect their package upon delivery and to contact Atlas & Geiger promptly if the package appears damaged or if the goods received are incorrect.

8. CUSTOMS DUTIES, IMPORT TAXES AND OTHER CHARGES

Atlas & Geiger products are shipped internationally from France unless otherwise indicated at checkout.

Depending on the destination country, an order may be subject to:

  • customs duties;

  • import taxes;

  • VAT or other local taxes;

  • customs clearance fees; or

  • other charges imposed by the authorities of the destination country.

Unless the website expressly states that such charges are included in the price paid at checkout, these charges are the responsibility of the customer.

Atlas & Geiger has no control over the amount of customs duties or taxes imposed by the destination country.

Customers are responsible for providing any information or documentation reasonably required by customs authorities to facilitate delivery.

9. RIGHT OF WITHDRAWAL

Where the customer is a consumer and applicable law provides a statutory right of withdrawal, the customer may withdraw from the purchase without giving a reason within 14 days of receiving the goods.

To exercise this right, the customer must inform Atlas & Geiger of their decision before the expiry of the applicable withdrawal period via the contact page form.

The customer may use the withdrawal form provided at the end of these Terms, but is not required to use that exact form provided that their statement clearly communicates their decision to withdraw.

Once the customer has notified Atlas & Geiger of their withdrawal, the goods must be returned without undue delay and, in any event, generally within 14 days from the date on which the customer communicated the withdrawal decision.

10. CONDITIONS FOR RETURNS UNDER THE RIGHT OF WITHDRAWAL

Returned products must be handled with reasonable care and should be returned:

  • unused, except to the extent necessary to inspect and assess the product;

  • in their original condition;

  • with their original packaging where reasonably possible; and

  • with any accompanying accessories or documentation.

The customer may be responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the product, where permitted by applicable law.

The right of withdrawal does not apply where an applicable legal exception exists, including, where relevant, goods made to the customer's specifications or clearly personalised.

11. RETURN SHIPPING COSTS

Unless otherwise stated by Atlas & Geiger or required by applicable law, the customer is responsible for the direct cost of returning a product following the exercise of the right of withdrawal.

Atlas & Geiger will inform the customer of this responsibility before the purchase is completed.

Where a product is returned because it is defective, damaged, incorrect or does not conform to the contract, the customer's rights are governed by the applicable statutory consumer guarantees, and Atlas & Geiger will bear any return costs that it is legally required to bear.

12. REFUNDS

Following a valid withdrawal, ARTENIS SARLU will reimburse the payments received from the customer, including the applicable standard delivery cost, subject to the rights and limitations provided by applicable law.

If the customer selected a more expensive delivery option than the least expensive standard delivery option offered by Atlas & Geiger, any additional cost resulting from that choice may be excluded from the refund where permitted by applicable law.

The refund will generally be made using the same payment method used for the original transaction, unless otherwise agreed with the customer and where permitted by applicable law.

Atlas & Geiger may withhold the refund until the returned goods have been received or until the customer provides evidence that the goods have been shipped back, whichever occurs first, where permitted by applicable law.

13. DAMAGED, INCORRECT OR NON-CONFORMING PRODUCTS

If the customer receives:

  • a damaged product;

  • an incorrect product;

  • a missing item; or

  • a product that does not conform to the order,

the customer should contact Atlas & Geiger as soon as reasonably possible via the contact page of the website.

The customer should provide their order number and, where relevant, photographs showing the condition of the product and packaging.

This procedure does not limit or replace any statutory rights available to consumers under applicable law.

14. LEGAL GUARANTEE AND DEFECTIVE PRODUCTS

Nothing in these Terms limits or excludes any mandatory statutory rights applicable to the customer.

Where EU consumer law applies, consumers benefit from the applicable legal guarantee for goods. Where a product is faulty or does not conform to the contract, the consumer may have rights including repair or replacement and, depending on the circumstances, a price reduction or refund.

For consumers outside the EU, the applicable statutory guarantees and consumer protections of the relevant jurisdiction will apply to the extent required by law.

The legal guarantee does not cover damage resulting solely from:

  • normal wear and tear;

  • improper use;

  • failure to follow care instructions;

  • accidental damage;

  • alterations or modifications made by the customer; or

  • damage caused by inappropriate storage, cleaning or maintenance.

15. CARE AND USE OF PRODUCTS

Customers are responsible for following any care and maintenance instructions supplied with the product or displayed on the website.

Natural materials may change over time as a result of normal use, exposure to sunlight, humidity, water, friction or other environmental conditions.

Such natural ageing does not necessarily constitute a defect.

19. FORCE MAJEURE

ARTENIS SARLU shall not be liable for delays or failures in performing its obligations where such delay or failure results from circumstances beyond its reasonable control, including, where applicable:

  • natural disasters;

  • extreme weather events;

  • customs interruptions;

  • major transportation disruptions;

  • interruption of telecommunications or payment services; or

  • other events that could not reasonably have been anticipated or prevented.

This provision does not affect mandatory consumer rights that cannot legally be excluded or limited.

20. APPLICABLE LAW AND JURISDICTION

These Terms are governed by the laws applicable to ARTENIS SARLU and its activities in Madagascar, without prejudice to any mandatory consumer protection provisions that may apply to customers in their country of residence.

Where mandatory consumer protection legislation provides consumers with rights that cannot be contractually excluded, those rights shall remain applicable.

For consumers located in the European Union, nothing in these Terms is intended to deprive them of mandatory protections granted by applicable EU or national consumer law.

Any dispute that cannot be resolved amicably shall be submitted to the competent court(s) in accordance with applicable law and mandatory consumer jurisdiction rules.

21. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary to make it valid and enforceable, where legally possible.

The remaining provisions shall remain in full force and effect.
